J <br /> 10. <br /> ARTICLE III <br /> HEARINGS <br /> Section 1 . - Notice <br /> Notice of hearings shall be advertised as required by the <br /> provisions of General Laws, Chapter 40A and Chapter 40B. In <br /> addition, a copy of the advertised notice shall be sent by <br /> mail , at least 14 days prior to the date of the hearing, <br /> postage prepaid, to the applicant, petitioner or appellant, <br /> to the owners of all property deemed by the Board to be <br /> affected thereby as they appear on the most recent local tax <br /> list to the planning board of every abutting town. <br /> Section 2 . - Hearings to be Public <br /> All hearings shall be open to the public, in accordance with <br /> the Open Meeting Law, except when the Board requires <br /> Executive Session . No person shall be excluded unless <br /> considered by the Chairperson to be a "serious hindrance" to <br /> the workings of the Board . <br /> The Chairman, or in his absence the acting Chairman, may <br /> administer oaths, summon witnesses, and call for the <br /> production of papers . <br /> Section 3 . - Representation and Absence <br /> An applicant may appear in his/her own behalf, or be <br /> presented by an agent or attorney . In the absence of any <br /> appearance without due cause on behalf of an applicant, the <br /> Board may decide on the matter using the information it has <br /> otherwise received . <br /> Section 4 . - Order of Business <br /> a. The Chairman, or Acting Chairman, shall call the meeting <br /> to order. Board of Appeals members in attendance shall <br /> be introduced and the Chairman shall announce the <br /> members sitting on each case . <br /> b . Reading of petition and legal notices by the Clerk, <br /> together with presentation of exhibits, if any . <br />
