°�N Town of Mashpee <br /> 16 Great Neck Road North <br /> Mashpee, Massachusetts 02649 <br /> BOARD OF HEALTH -- PUBLIC SESSION MEETING <br /> Mashpee Town Hall —Waquoit Meeting Room <br /> Minutes of the Meeting of June 7, 2018 <br /> Board Members Present: Member Absent: Also Present: <br /> Brian Baumgaertel, Chair Mallory Langler, Clerk Glen Harrington, Health Agent <br /> Laurel Almquist, Co-Chair <br /> Chair Brian Baumgaertel called the meeting to order at 7:01 PM. <br /> APPOINTMENTS <br /> 7:15 PM — Public Hearing — Draft Tobacco Regulation. <br /> Glen Harrington stated that the Board of Health had previously reviewed a draft model regulation that was <br /> based upon recommendations from the US Food & Drug Administration and the State Attorney General's <br /> Office. There were nine items or policy decisions that were not included in the existing Board of Health tobacco <br /> sales regulation. The nine items have been incorporated into the draft regulation and forwarded to the tobacco <br /> retailers. <br /> Mr. Harrington was contacted by one of the tobacco retailers in Mashpee, and he completely outlined the <br /> proposed changes of the draft regulation. No comments were received from other Mashpee retailers, but the <br /> Board of Health did receive a fetter from the Coalition for Responsible Retailing. <br /> Bob Collett, Director of the Tobacco Control Program Division of the Barnstable County Department of Health <br /> and Environment, introduced himself to the Board. <br /> Mr, Collett stated that the regulation, which was presented this past winter, is representative of the most <br /> comprehensive best effective evidence-based regulation that local Boards of Health should consider to prevent <br /> young people from acquiring tobacco products. Vaping products are popular and a concern since there are <br /> 15,000 flavors. Most will use this product thinking it's harmless but eventually will smoke cigarettes and other <br /> products. The regulations are being adopted by several hundred communities statewide. <br /> Brian Baumgaertel invited the public to express their comments on the draft Tobacco Regulation by <br /> approaching the microphone and stating their name. <br /> Bryan Anderson, owner of Andy's Market, introduced himself to the Board. <br /> Mr. Anderson commented that the tobacco problem should be approached in the same manner as was <br /> accomplished with alcohol. It took many years for the State to hold the minor responsible and not the retailer. <br /> Mr. Anderson discussed the age verification, identification, and enforcement. He also mentioned the eligibility <br /> of obtaining permits at the transfer of a business, the sale of tobacco products prohibited within a certain <br /> distance to schools, and the only flavored products that are acceptable. <br /> Sheryl Sbarra, Director of the Policy and Law for the Massachusetts Association of Health Boards, introduced <br /> herself to the Board. <br /> l <br />
