♦ Y <br /> AGREEMENT BETWEEN NEW SEABURY COMPANY, LP. <br /> AND THE <br /> CAPE COD COMMISSION <br /> RE: SEWAGE TREATMENT AT NEW SEABURY <br /> New Seabury Company L.P. hereby enters into an agreement with the Cape Cod Commission to restrict the <br /> disposal of effluent from waste water treatment facilities to the geographical locations as defined by the following <br /> criteria: <br /> 1. Disposal areas shall include those parts of the New Seabury golf courses and land located in the <br /> Special Permit Area and shall be sited so that the effluent will not have a detrimental impact on <br /> natural bodies of water or domestic public water supplies. Furthermore, no wastewater disposal <br /> area shall be located within the perimeters of the Waquoit Bay Area of Critical Environmental <br /> Concern. <br /> 2. New Seabury agrees that both Treatment Plants 1 and 2 shall be subject to independent review <br /> by Weston and Sampson Engineers in accordance with the regulations of the Mashpee Board of <br /> Health. <br /> 3. The groundwater down gradient from the effluent disposal fields shall be monitored by annual <br /> testing for determining the presence of any pathogens which have the potential for poising a <br /> health hazard to swimmers in Nantucket Sound. If potentially harmful levels of pathogens are <br /> found in the groundwater, the effluent from the treatment plant shall be treated by UV, Chlorine <br /> dosing, Ozone or other appropriate method to reduce the pathogens to acceptable levels. <br /> 4. Prior to the operation of a Treatment Plant, provisions shall be made for the disposal of the <br /> sludge material generated by the plant through one of the following methods: a) Removal to a <br /> composting site, b) removal to a sludge treatment facility, or if none of these options are <br /> reasonably available, c) removal to a sanitary land fill or any other disposal method as permitted <br /> by local, state and federal regulations. <br /> S. It is agreed that no fees shall be due the Cape Cod Commission from New Seabury for the <br /> duration of this agreement on any sewage treatment issues within the area covered by the New <br /> Seabury Special Permit. <br /> 6. Any waste water disposal in Sections 11, 13, 14, 15, 17, 18, 20, 21, 22, and 23 shall be deemed <br /> to have no detrimental impact and shall not require denitrification. <br /> In consideration of the above the Cape Cod Commission shall have no further jurisdiction with respect to sewerage <br /> treatment in any of the New Seabury sections subject to the special permit. <br /> Both parties indicate their agreement to the terms as stated above by the signature of authorized representatives: <br /> For the For the <br /> CAPE COD COMMISSION: NEW SEABURY COMPANY, LP.: <br /> Date: Date: <br /> 126.ccc <br />
