BOX 1108 <br /> MASHPEE, MA 02849 <br /> 4771777 <br /> MASHPEE BOARD OF BOARD OF HEATH <br /> REFUSE REGULATION <br /> RTIONALE• <br /> The participating communities of Mashpee, Falmouth, <br /> Sandwich and the Massachusetts Military Reservation (MMR) in <br /> 1987 agreed to a joint solid waste disposal solution by <br /> jointly funding the cost to engineer, construct, operate and <br /> manage the Upper Cape Regional Transfer Station (UCRTS) lo- <br /> cated at the MMR. Under Chapter 40, Section 44 of the Massa- <br /> chusetts General Laws such regional, inter-municipal refuse <br /> disposal is strongly encouraged. <br /> Continued landfilling of our solid wastes, although at <br /> first might appear the lesser expensive method of refuse <br /> disposal in those communities where space remains available, <br /> however, the side effects of landfilling is the potential <br /> contamination of groundwater. <br /> This has been documented in <br /> various Cape towns and the associated clean-up costs far <br /> outweigh the cost benefits of landfilling. Furthermore, <br /> landfills in the Commonwealth will soon be mandated to <br /> close. <br /> The responsibility for the control of TRANSPORT and RE- <br /> MOVAL of solid wastes falls under the jurisdiction of local <br /> Boards of Health, M.G.L. Sections 31A and 31B of Chapter <br /> 111. Annual permits to transport garbage are issued by <br /> Boards of Health. Furthermore, these Sections grant local <br /> Boards of Health the authority to adopt and enforce regula- <br /> tions regarding such transport. <br /> The Upper Cape Transfer Station Board of Managers, <br /> following a public comment period, adopted a set of rules <br /> and regulations for the operation of the station in May <br /> � r <br /> 1989, with subsequent amendments adopted in August 1989 and <br /> in November 1990. Section 2 of these regulations instructs <br /> trash haulers, licensed by Boards of Health, which routes <br /> are to be taken to access the transfer station. Amendment #3 <br /> specifies penalties to be assessed to companies whose driv- <br /> ers fail to use the approved routes. All licensed trash <br /> haulers have received copies of the rules and regulations <br />
