McGuire questioned whether. the regulation rust be <br /> promulgated by the State. <br /> Mr, Greelish explained that the Board of Health has the <br /> authority to adopt the regulation without State promulgation. <br /> Mr-. McGuire questioned Town counsel as to whether the <br /> Town would be prepared should there be a catastrophic acci- <br /> dent and whether the town could be held liable as they are <br /> the licensing authority. <br /> Nor. Greelish responded, the Board of Health is respon- <br /> sible for the environment, 'Specifically within our powers <br /> is the control of any vehicle transporting any substance that <br /> could pose a► health risk," <br /> Attorney Reardon stated the regulation adopted by the <br /> Board of Health does not limit what may be hauled. "it is <br /> unrelated to the size truck or its capacity, it is solely re- <br /> lated to the siphoning of water from a water body and is de- <br /> signed to present the accidental interchange of pesticides <br /> with thosewaters. " "of necessity a section of the regulation <br /> addresses the issue of safety devices to prevent the acciden- <br /> tal backflow of pesticides into water bodies. " <br /> Mr. Greelish commented, the regulation was brought about <br /> due to faulty equipment, 'The vehicles are inspected to en- <br /> sure the spraying apparatus is functioning properly. " <br /> Mr, McMahon questioned whether the Board intends onso- <br /> liciting other organizations. <br /> Mr, Greelish responded, this Board is presently review- <br /> ing the issue. <br /> Mr. McMahon stated siphoning is a violation of the State <br /> Pesticide Bureau. "If there are any questions about pesti- <br /> cide applicators in the fie-ld the Pesticide Bureaux should be <br /> contacted. " Mr, McMahon explained that it is the individual <br />
