I <br /> MINUTES September 2 , 1991 2 BOARD OF HEALTH <br /> Mr. Greelish motioned to forward a letter to the state, <br /> n behalf of the School Department, requesting a variance <br /> from the state Plumbing Code, 248 CMR 2 -10 , Mr. Costa sec- <br /> onded. <br /> POITME Gail Robinson - 11 Bowsprit Point <br /> Ms, Gail Robinson, Mr. Michael McGrath, Attorney Jerry <br /> Carter and Ms. Judy Mills were in attendance for this sched- <br /> uled public hearing. <br /> M , McGrath presented certified mail receipts to the <br /> Board. <br /> Mr. McGrath informed the Board plans have not been re� <br /> vised. "The proposed leaching facility is 75' from the edge <br /> of wetlands, delineated from the edge of the phragmites) and <br /> 107' from the saltmarsh, Mr. McGrath stated, in his opin- <br /> ion,,.4*-, the phragmites are not _the, same values as almost any <br /> bordering vegetated wetlands, Under the phragmites there is <br /> a hole -ar alg mum ;of s its. 11 "The' water table between the <br /> pit and phragmites is 'el vated under the phragmites due to <br /> the small pore size in the soil of the phragmites, which is <br /> typical � from ,soils deposited from dredging. " "1n spearing <br /> with a representative from New# Seabury it was learned dredg- <br /> ing was performed in that area. " "The water tables pitches <br /> down, and underneath the fill organic ,matter was found. " Mr. <br /> McGrath explained, 'in his opinion, any effluent will flow <br /> down +and F nder+n'eath* ,P' 0 "Effluent' thru peat has been found to <br /> have significant denitrifying capabilities. " <br /> Mr. McGrath stated this Board has shown reluctance in <br /> approving placement of the leaching facility within 100' o <br /> the wetlands. "Plans were reprised delineati g the system in <br /> the street however, it was learned Planning Board approval <br /> would be required. " "Subsequently we met with the Planning <br /> Board who indicated placement of the leaching facility within <br /> the layout of the street would set a dangerous precedent, " <br /> Mr. McGrath stated, he is present this evening in hopes that <br /> Board- of Health regulations call for the saltmarsh to be the <br /> protected wetland and therefore will consider placement of <br /> the leaching facility within 75' from the phragmites and 107+ <br /> from the saltmarsh. "I believe that the particular citcum- <br /> stances underneath the phragmites, that has been proved by <br /> the soil logs testified to, show the same protection of the <br /> environment that you have if 1001 from the phragmites could <br /> be obtained. Mr. McGrath explained this is the last remain-- <br /> ing lot on Bowsprit Point. 'surrounding homes in the area <br /> were constructed must closer to the saltmarsh. " <br />
