r i TWT OF 1ASPEE BOARD OF BEALTH March 13 3 1997 Meeting called to order at 7:00 p.m. Members present: Robert F. Cram, Sr., Steven R. Ball and John T. Doherty THE TAPE IS NOT PART OF THE MEETING IT IS FOR THE PURPOSE OF TRANSCRn TIN ONLY. Mr. Robert F. Cram, Chairman 1. Warrants signed. . 2. Mr. Doherty motioned to accept the minutes of March 6, 1997, Mr. Ball seconded, all agreed. UNSCHEDULED P INTMENT- James Bernard- 12 Great River Road Mr. And Mrs. James Bernard was in attendance to request the Board reconsider their vote of March 6, 1997 which denied variance relief. Mr. McQuaid stated, "This matter was before the Board lastweek." "It's an upgrade from a cesspool septic system to a maximum feasible complying Title v system." "This upgrade is based on the fact ,that a septic system inspection was done because the property is on the market for sale." "The cesspools were not in failure it was just their proximity to Great River was such that it rendered an automatic failure." "Cape Islands Engineering designed a plan to upgrade to the maximum feasible compliance however, although.increasing the distance to Great River from the,existing cesspools the proposed leaching facility would only be 2' from the edge of a retaining wall on Cheat River." "It was the Board's decision last week to deny the plans and suggest that the applicant at least consider bringing in a denitrification system." "I have since then been informed the applicant was informed that we would grant the necessary variances for the upgrade considering that what was proposed is better than what's existing as long as the applicant signs the affidavit saying that he or his successor owners would not propose increasing the square footage of the building." "The applicant is here before us to present his side of the story."
