• <br /> WNUTES December 4, 199'7 5 BOARD OF HEALTH <br /> Ms. Stevens stated, `You're declaring it unbuildable as of today." "I'm also going <br /> to sue for whatever damages we are able to get beyond that because the property is now <br /> worthless." "At the very least I'm going to small claims court immediately for $2400.00 <br /> in taxes since 1990." `It's find of silly to be owners of a piece of property that's worth <br /> o.00." "Flood levels haven't been anywhere near the level they are mal xng us adhere <br /> to since July of 1973." <br /> Mr. Doherty stated, "Unfortunately, the abutting lot did have a problem." <br /> IVIS. Stevens stated, "Obviously,they are going by the hundred year flood rate." <br /> Mr. McQuaid stated, "The abutting property's septic system there failed after <br /> eighteen months from high groundwater." <br /> Mr. Doherty relayed, "Groundwater elevations fluctuate throughout the year." <br /> "This is hove the engineers come up with these formula's." "Unless you intend on <br /> installing a small treatment plant or you want to do something other than the passive Title <br /> V system f don't see how this Board could grant a variance." <br /> IVIS. Stevens stated, "You can't put a treatment plant or anything for new <br /> construction according to the Mate laws so a lot of properties in Ma tepee are <br /> unbuildable." <br /> Mr. Doherty commented, `This Board has authorized a number of alternative <br /> systems for new construction." "The Mate has approved several different ones." "we <br /> would consider an alternative system for this lot based on the engineers information.." <br /> IVIS. Stevens stated, "what systems do you suggest and approve o " <br /> Mr. Doherty relayed, "We cannot suggest however, we would recommend you <br /> consult with your engineer. <br /> " <br /> Mr. Evans stated, "I don't thinly Ms. Stevens 'is up to slate on her Title V. <br /> Ms. Stevens stated, "I just received this information a few weeks s ago." <br />
