NfINUTES August 1, 1996 7 BOARD of HEALTH Mr. Doherty stated, "'If they were running 24 hours a day continually drawing I night buy that argument but I am not convinced." IIs. Wilson relayed, "The other issue here I think, about voting on the variances tonight, I understand your regulations and variances are not uncommon in situations like this but where there is the addition of a Title V variance that's needed it seems to be that the procedure needs to be gone through, 'Title V requires abutter notification and what have you." "My understanding is that there was no public notification." Mr. Doherty stated, ""You have the green cards." Mr. Lupo stated, "I don't the my name is on the green cards." "I had to go t the Board of Health for this extra hearing." "I was told by the Board that unless there is a violation of Title v it didn't have to notify abutters.' MI . S anicki stated, "I do have the green card from Mr. Lupo. Mr. Lupo responded, I didn't sign the green.card." Mr. Sandi stated, "Somebody must have signed for you. Mr. Doherty stated, "Unfortunately, whether you signed for it or not it's good enough for legal requirements." Mr. Lupo stated, "Can we go through the first set of notes because I was never notified of that."' "I was notified of the Conservation Comrmssion meeting."' "Maybe that is what it's for. Mr. Sanicki stated, "No.'s Mr. Lupo stated, "I have to beg to differ with you David because there is no way, shape or form I brought this up and if you check the minutes of the first meeting I had with the Board of Health." Mr. McQuaid stated, "When we first approved the plans and Mr. Lupo came to and questioned the wells and said hold ofd'." "we called Cape & Island and informed them we want a full Title V hearing notifying all the abutters., "I certified the list of abutters and since then it's been continued." "Abutters do not have to be renotified." "'The Board of Health originally, back in May approved the plans."
