rr 41 <br /> BOARD of SELECTMEN <br /> Executive Session <br /> March 26 , 1980 <br /> The Meetinct was called to order at : 10 Q.m. ' in the Selectmen' s <br /> Meeting Room. Present were: selectmen Benway, Garland and O'Connell, <br /> and Town Counsel , .Joseph Reardon, and Police Chief O' Connor. <br /> First -order business was the discussion of what to do about <br /> The Farm, the issue being to close The Farm for three consecutive days. <br /> Mr, Garland stated he proferred Monday, Tuesday and Wednesday. <br /> Mr. Benway recommended Wednesday, Thursday and Friday. He reminded the <br /> Board d that they should be careful- so that the ABCC doesn ' t intervene, <br /> and be sure that these grounds will stand up in court. After much dis- <br /> cussion, it was agreed that a letter should be sent iris the Police <br /> Department, stating that a three day suspension on the dates April. 9 . <br /> 10 and llwi ll be enforced. <br /> Chief O' Connor brought exp the fact that three of his officers <br /> have refused- to go for annual physicals . Mr, Garland stated� that Frede- <br /> rick Di Iorio of Mashpee has filed a complaint against the Town to the <br /> State that "people" should be alto wed .to go to their own physicians for <br /> physicals . Chairman O'Connell stated that the Town has the -right to <br /> have their own doctor, and those who do not wish to take into considera- <br /> tion what has been subscribed, do not have to. <br /> Town Counsel stated that all town employees shall be certified <br /> by the Town Physician. The original article stated that all town <br /> employees. shall be certified by the Town Physician. The Personnel Ad- <br /> ministration Plan shall formulate a policy, with the approval of the <br /> Selectmen, and chances could be rade from time to time, and no require- <br /> ments . <br /> Problem: The Chief of 'the Department should set up program whereby <br /> there will be periodic examinations at the expense of the Town. The <br /> Personnel. Administration Plain has no . right at the present to do so. How- <br /> ever, the Chief has made them do it. A general regulation will be drawn <br /> up stating that periodic exams will go into effect. Employee shall sub- <br /> mit to a physical exam at such time as the Chief directs , at no cost to <br /> the employee. - According to this rule , it will be necessary for the three <br /> dissenint employees to undergo a physical. Town Counsel stated that it <br /> is important . for there to -go to the Town Physician, as we cannot accept a <br /> report from other doctors. The choice should not be the employee l s . <br /> Mr, Kokmeyer entered the room. He stated that he has been getting <br /> lip service from Koblinsky. He has . applied for unemployment security, <br /> and it will be granted. This is much cheaper than paring him on LL11.1F. <br /> Chief o' onnon stated that he could ask Dr. Ravin -to check him over, and <br /> he could come back and the Chief would design a job for him, such as dis� <br /> patcher. Chairman O' Connell stated that this cannot be done. A man could <br /> come back of his own volition and do normal work, - which is out on patrol. <br /> Mr. O'Connell states he won' t do this; Mr, Benway suggested it would force <br /> his hand. <br />
