If an artier' is submitted to . the Town Meeting seeking to have the
Town take over ownership of the bridge by eminent domain, I would
be compelled to point out to the seledtr erri that this is - going to
be sort of an island- 'in -the middle of I d oft know what, because
the Town does not own the approach 'to or' the road on the other
side. so the Town, technically, will be -owning a very short piece
of this road without any legal deeded rights or lawful and legal
means to get to it and this raises another problems - it would be
most logical .if the Town takes the bridge, to also take as a
covered way the way going onto the bridge,
4. Town Counsel informed Mr. Hollander that the first thing that has
to be done is to determine ownership -and second is to 'bring fast
action against the owner in the nature of a 93 suit.
166 - Chair an Benway stated that "My Bare is looking for a Grote to change
manager .-from Thomas Leary to Everetton Lashley, Motion was made
by Selectman Thomas, seconded by Selectman' Garland* Vote was not
declared .-unanimous. fir. Blakeman 'had . requested to ask a question
regarding' this, chairman allowed open discussion,
. Blakeman asked if Toni Leary had come in and requested this
change..' He stated that the only thing in Tom's - favor was that the
- liquor license -was in his name .
Town Counsel. informed Mr. Blakeman that the liquor license was not
ire the name of Torn Lary - it' s in the name of Icy Bair Inn, directing
hien as manager -•- managers exist by vitu'rre of a Grote , of the directors
- of a corporatio . What you've got there -is a , resolutibn from the
directors, I don' t think that the Hoard can look beyond that
,resolution.,
Mr. Blakeman stated that- he-Anew. that Tom has_ a . lawy .r- ,wor.king on
th'i - and "all that' he, was trying to suggest . ►rasq- th3 -eith y To i ,or _
h.l. =:_Iawy r-.-Meet- with!,the- He ar
h'airman Benway stated --that he did-not th-ihk 'that' it rai I s, in our
inability to go beyond this resolution and seal, if there' s something
wrong, but they will have to present themselves and say so.
Town Counsel. stated .that he9 spoke to Jim Querk on this about 3 months
or so ago and .also spoke to Lashley because Lashley had made an
.inquiry to the Board which had been referred to hien. He came to
my office to see me, and I told Shim what he had to do for a transfer.
He thoug4t or he was .advised that he had to file an application for
a new license and go through a hearing. Querk callers me on this
particular thing. Querk told nye that Leary had sold his stock t
Lashley and he called me because Lashley had told him that he had
been into see me regarding a transfer of the license . The next
thing that happen was that I got a call from some attorney in Boston
because Lashley was apparently refinancing or other rise doing
something to his mortage I presume to pay off Leary and the other
guys - I don' t know. Anyhow, I was called by the attorney in
Boston asking about the liquor license transfer - he apparently
called the Selectmen's office and was told that they would hare. to
go through a hearing.
- 7-
