y <br /> R_ MINUTES F OF MEETING <br /> October 3, 1980 <br /> Present: Chairman George A. Be way, Jr, , electmen Chester A. Garland, <br /> B. Jean Thomas and Town Counsel. <br /> 1. Meeting was called to order at 7: 00 p.m. by chairman Bex�way, <br /> . Chairman made the following statement to voters who were .present <br /> regarding the Selectmen' s vote on the Agreement of South Cape <br /> Beach: <br /> "There will not be any v to on the South Cape Beach Agreement <br /> tonight. The Agreement will refer to the exact motion as <br /> was rade on the floor but it has not been put in black and <br /> white yet by the State. we have been in touch with the <br /> Attorney General through Counsel, and they said we will have <br /> it by the end of the week. If not by then, the first part of <br /> next week. That"s.s the latest word as of p.m. this after- <br /> noon. <br /> fter- <br /> no n. Until we have that before us, there is no vote that <br /> e can tape relative to South Cape Beach-, " <br /> VOTER: If you have it by next week , will we be in here <br /> next Wednesday? <br /> CHAIRMAN: Yes. <br /> VOTER: What- vote will you take <br /> CHAIRMAN: The Selectmen are the only authorized body to vote <br /> under the law as it stands now authorizing the <br /> Department of Environmental Affairs to- make a <br /> taking by eminent domain of any land in the Town of <br /> Ma hp e e. <br /> VOTER: what have the Townspeople told you? <br /> CHAIRMAN: The have instructed us that vote o advised us <br /> They � <br /> not insturcted us . . . . <br /> VOTER: They instructed you., <br /> i <br /> CHAIRMAN:: o. Negative . Depends upon"v how you legally know . . . . <br /> VOTE : we' ll ask Counsel about that. <br /> CHAIRMAN: I have already asked Counsel about that. It' s <br /> advisory only. Now this body here, the Selectmen, <br /> went to Town Meeting for that advice. we didn' t <br /> have to go to Town Meeting for that advice. <br /> VOTER: why was it that war before? <br />
