don' t know where we stand at that point, <br /> TOWN- COUNSEL; One thing perhaps to add a little clarity to it, that <br /> Agreement that was passed out by the DELI at Town <br /> Meeting if you recollect, one of the specific clauses <br /> in that Agreement decided that the obligation of the <br /> 'own to go forward on it is conditioned upon the <br /> Attorney, General approving i t. If the Attorney <br /> General disapproves .either in wholer in part, then <br /> that gives the Town . the opportunity to review what- <br /> ever they disapproved in whole or in' part and the <br /> Town was not bound to go forward. <br /> VOTER: when you use the word Town, what. do. you mean <br /> TOWN COUNSEL: I 'm talking now about the Board of- Selectmen. Also, <br /> I might add the - Town Meeting vote , The -Town Meeting <br /> voted to . ad- t that Agreement.. That Agreement within <br /> itself contains a proviso wh-ich sags that in --effect <br /> that tie Town Meeting vote - woul-d not be effective to <br /> bind even the voters that voted' for i if the Attorney <br /> General modified that Agreement. <br /> VOTER: Mr. Benwa r, I have two questions . Management, on behalf of the Commonwealth <br /> of Massachusetts , for the acquisition of South Cape <br /> Beach and the creation of south Cape Beach State Par] , <br /> as are contained in a written document entitled, "Agr.ee- <br /> me t" , a copy of which is in the hands of the Moderator, <br /> and that the Selectmen be authorized and instructed to <br /> approved the acquisition by eminent domain and/or <br /> purchase. and/or lana exchange of said South. Cape Beach <br /> State Park by the' Department of Environmental <br /> Management. " Motion carried, <br /> VOTER: Ok the second part of .my question, Mr-. Benway, is this . <br /> You say that in that vote the word is to instruct the <br /> Selectmen, night? <br /> CHAIRMAN: well there' s a previous word, to aid the acceptance of <br /> by the Commonwealth. <br /> i VOTER, Right but It also sags to instruct the Selectmen. <br /> CHAIRMAN: Yes <br /> VOTER.
