Select-man Thomas -do you wish to <br /> comment? <br /> - :.ELE 'I'11AN' 'THOMAS: I have every intention to follow out the direction of <br /> the people in the Town. I ars for the State taking <br /> rholeheartly and I would do nothing -to impair the <br /> State 'taking. I would sign the document a's soon a <br /> possible. ThisAgreement that was put together is <br /> very complex an d very lengthy, It took 8 drafts t <br /> get to the' final draft to to Town Meeting and <br /> whether the Attorney General is going to raise any <br /> questions on particular words , phrasing, I have no <br /> idea. I am for it and I arra positively going to sign <br /> for the eminant domain taking by the State. <br /> S L 'CT A 'GARLAND: I'd, like to say that the one thing that is lost in <br /> the general discussion is that there are actually <br /> two documents that are involved here , one is the <br /> Agreement that Mrs. Thomas j,ust referred to, and the <br /> second is the vote of this Board in essence giving <br /> the right of eminent domain to the State'. I tried <br /> to express an opinion the other night unsuccessfully. <br /> Unless the Attorney Geheral that document as it was <br /> presented to us and presented to you peoplb -in which <br /> you voted, if it .is changed in anyway, shape or <br /> fashion, that may or may not with the advice of <br /> Counsel prove to be detrimental to the wishes of this <br /> Town, I will not sign it., nor will I sign the consent <br /> for eminent domain. The reason being and which I <br /> tried to point out the other night, there are presently <br /> two pieces of legislations in existence which are <br /> substantially different, way substantially different, <br /> from which you people felt was the proper Ag-re meat <br /> to be signed by this Board. The concluding paragraph <br /> of the Agre ment says in effect that if any portion <br /> of that Agreement is found to be in error by the <br /> Attorney General , the entire Agreement is null and <br /> void. If we sign both documents prior to the approval <br /> of the Attorney r General' office, prior to knowing <br /> exactly how it's going to read, and that document as <br /> e know it today proves to be mull and void by that <br /> last paragraph, we then have the second document <br /> -7- <br />
