TOWN COUNSEL: I couldn' t possibly sit here and speculate.
CHAIRMAN: I don' t think it's your -main questio.n.
VOTER: It' s the remain of a question, Mr. Benway . . . .
CHAIRMAN: Excuse nye. In this particular case we are referring
to specific not general legislation but specific
legislation past relative to South Cape Beach at
the, request of Dick Kendall, the Commissioner and
in it, it said that the Board of Selectmen' -approval
is required. Not Town Mdeting, not a combination of
either but just the Board of Selectmen. I think that' s
pretty clear-.
VOTER I thinly what you are running into tonight is a Little
bit of frustration. Probably resulting from - some .
misunderstanding and anxiety on the part of the people.
Once before, years ago, there was a misunderstanding
on a Grote on the South Cape Beach subject where the
people thought they hal voted and li n.' t realize, it
was .a directive type of vote. Unfortunately, I think
slot of people at the Town Meeting were under the
same impression. Some of us knew it was a directive,
others felt it was a hi ndi ng vote". I think it has
been made clear tonight, that it was - a directive.
I think what they are falling back 'on, is why there
was even a Town Meeting and why there was an artic1
for which there was a directive which then comes back
to the Board of Selectmen. You stated yourself that
you felt that it was such an important issue within
the Town, that you warted the diretion of the people
- so that you would be going. with them.
CHAIRMAN: You just answered the question.
VOTE : I know. I 'm trying to explain. I think what probably
might help is that if the people here tonight, knew
that vote by the Sele'ctnen when the Agreement is
received by the State, will follow the direction of
the people.
CHAIR
eople.
CHAIR AN: I. can only 'speak - for myself, and the other two memhe r
can speak for themselves . I- will reale my statement
first. The intent. of the Town Mting was to follow
the Agreement as hammered out between the Commonwealth
of Massachusetts ' and the -South Cape Beach Advisory
Committee para raph' y- paragraph. and word by word.
I thinly &nybody who read it carefully, each word
carries significance. That is ghat I want to see
and if it is that before me, I will vote for it.
If it i.s something different, thea I am going to
have ' to go back and review it with Counsel, South
Cape Beach Committee and see where we are. I fully
expected to request ekactly the vote of the Town
Meeting,
- -
