TOWN COUNSEL: I couldn' t possibly sit here and speculate. <br /> CHAIRMAN: I don' t think it'�s your -main questio.n. <br /> VOTER: It' s the remain of a question, Mr. Benway . . . . <br /> CHAIRMAN: Excuse nye. In this particular case we are referring <br /> to specific not general legislation but specific <br /> legislation past relative to South Cape Beach at <br /> the, request of Dick Kendall, the Commissioner and <br /> in it, it said that the Board of Selectmen' -approval <br /> is required. Not Town Mdeting, not a combination of <br /> either but just the Board of Selectmen. I think that' s <br /> pretty clear-. <br /> VOTER I thinly what you are running into tonight is a Little <br /> bit of frustration. Probably resulting from - some . <br /> misunderstanding and anxiety on the part of the people. <br /> Once before, years ago, there was a misunderstanding <br /> on a Grote on the South Cape Beach subject where the <br /> people thought they hal voted and li n.' t realize, it <br /> was .a directive type of vote. Unfortunately, I think <br /> slot of people at the Town Meeting were under the <br /> same impression. Some of us knew it was a directive, <br /> others felt it was a hi ndi ng vote". I think it has <br /> been made clear tonight, that it was - a directive. <br /> I think what they are falling back 'on, is why there <br /> was even a Town Meeting and why there was an artic1 <br /> for which there was a directive which then comes back <br /> to the Board of Selectmen. You stated yourself that <br /> you felt that it was such an important issue within <br /> the Town, that you warted the diretion of the people <br /> - so that you would be going. with them. <br /> CHAIRMAN: You just answered the question. <br /> VOTE : I know. I 'm trying to explain. I think what probably <br /> might help is that if the people here tonight, knew <br /> that vote by the Sele'ctnen when the Agreement is <br /> received by the State, will follow the direction of <br /> the people. <br /> CHAIR <br /> eople. <br /> CHAIR AN: I. can only 'speak - for myself, and the other two memhe r <br /> can speak for themselves . I- will reale my statement <br /> first. The intent. of the Town Mting was to follow <br /> the Agreement as hammered out between the Commonwealth <br /> of Massachusetts ' and the -South Cape Beach Advisory <br /> Committee para raph' y- paragraph. and word by word. <br /> I thinly &nybody who read it carefully, each word <br /> carries significance. That is ghat I want to see <br /> and if it is that before me, I will vote for it. <br /> If it i.s something different, thea I am going to <br /> have ' to go back and review it with Counsel, South <br /> Cape Beach Committee and see where we are. I fully <br /> expected to request ekactly the vote of the Town <br /> Meeting, <br /> - - <br />
