Officer Ames : We held the dog for 17 days at Temrock Kennels
• under a quarantine. On two occasions when I
saw the dog there -- I ' ve had no physical contact
with the dog -- Mrs . Johnson took the dog over and
Mrs . Johnson removed the dog from. Temrock, however,
once I try to feed the dog and it attempted to bite
me . It is not a friendly dog other than to the
Johnson family and it does appear to be to friendly
to this young man.
Town Counsel: Do you have any specific recommendations you would
like to make to the Board in your capacity as Dog
Officer of the Town?
Officer Ames : Well, if the dog is a protential bitter or if it
annoys anyone in this Village, that we have it
removed from this Town. It is a recommendation
that I have made in the past and that' s the
recommendation I will make now.
Town Counsel: Let' s get the .record straight on this . You don' t
know of anyone that the dog is annoying in this
Village.
Officer Ames : . Yes I do. He is present here now but has choosen
not to testify.
Town Counsel: Yes Mrs. Binienda do you have somethingY ou want
to say about the dog annoying anyonebybarking
or . . . .
Mrs. Binienda: The dog barks and chases my husband if he is out
walking. He has to walk because of a back problem.
Town Counsel: Does the dog annoy you when it is tied up? When
it is tied up it doesn' t chase you Mr. Binienda?
Mr. Binienda: No it doesn' t.
Town Counsel: I think it would be appropriate at this time , for
the owner of the dog to address the Board. There
is no statutory .requirement that she give testimony
under oath. There is a statutory requirement that
the complainants give testimony under oath. I ' ve
going to stick strictly to the letter of the
statue that does not require that Mrs. Johnson give
testimony under oath because there isn 't any
requirement that she be placed under oath.
Mrs . Johnson: I will give it under oath.
• Town Counsel: That' s alright. You may say anything that you
would like to at this time to the Board.with
reference to -the dog.
Mrs. Johnson: The dog was given to us to protect our. home.
