Box 1108 <br /> Mashpee , MA 02649 <br /> RE: Moderator' s Pay <br /> Dear Joe : <br /> I am writing to confirm my prior oral opinion which I rendered to you <br /> severalweeks ago . I would. also indicate to you that the same opinion <br /> has been delivered by me to Frank M. Leonardi , the Moderator. <br /> The Board is not obligated to pay the Moderator the full amount appropriated <br /> at the Annual Town Meeting. My decision is based upon the fact that the <br /> oderator resigned his office prior to the completion of his term to which <br /> e was elected and, more importantly, prior to the expiration of the fiscal <br /> ar for which the salary was appropriated. <br /> The Board would have the right. to authorize payment of a lesser amount <br /> than that appropriated. This -right is inherantly within the power of <br /> the administrative discretion the Board possesses as the Chief Executive <br /> Officers of the Town. <br /> In my opinion, the Board has the power to pay to Mr . Leonardi the full <br /> amountof his salary if it chooses to do so , or to pay him any part <br /> thereof remaining unpaid, as of this time , based upon a fair apportionment <br /> of the work performed to date in the performance of the elected office . <br /> rs very ruly, <br /> bs;ep/ J.
