(n) Acts in a manner designed, likely or tending to cause or <br /> provoke disturbance in any public building or place of bus- <br /> iness wherein matters affecting the public are being con- <br /> sidered or deliberated and which is designed, likely or <br /> tending to interfere with the orderly conduct or procedure <br /> . of such consideration or deliberation after being warned by <br /> any person in authority to refrain from such conduct; <br /> (o) Frequents any public place with the intention to obtain <br /> money or other things of value from another or others by <br /> illegal or fraudulent schemes, tricks, artifices or devices; <br /> (p) Assemble for the purpose of engaging in any fraudulent schemes, <br /> devices , artifices or tricks to obtain any monies or things of <br /> value in any place or places from any person or persons; <br /> All pronouns used herein shall be construed in the masculine, feminine or <br /> neuter genders, and the term "person" shall be construed in the singular <br /> or plural and shall include real persons, associations or corporations. <br /> SECTION 3. EXEMPTIONS. <br /> This ordinance shall not be construed to suppress the right to lawful <br /> assembly, picketing, public speaking, or other lawful means of expressing <br /> public opinion not in contravention of other laws or ordinances, nor to <br /> infringe upon the right of any law enforcement officer engaged in the <br /> performance of his duties. <br /> SECTION 4. PENALTIES. <br /> �Any person who violates Section 2a, 2b, 2c, 2d, sahll- be subject to a fine: <br /> of Fifty (50..) dollars for the first offense and One Hundred (100. ) dollars <br /> for a second or subsequent offense. <br /> Any person who violates Section 2e through 20 shall be punished by a fine of <br /> Twenty-Five (25.) dollars: <br /> Any. such violation shall constitute a seperate offense on each successive <br /> occurrence. <br /> "The provisions of Massachusetts General Laws Chapter 40, Section 21D provid <br /> ing for the non-criminal disposition of by-law violations shall - be applicable <br /> and the person taking cognizance of any. violation shall have available as an <br /> alternative to initiating criminal .proceedings the procedure set forth in <br /> Section 21D .as aforesaid. " <br /> SECTION 5. <br /> "In the event that any part of this by-law is found to be inconsistent with <br /> any other provisions contained in other sections of the Town by-laws, it is <br /> intended ,that this particular by-law shall take precedence and control . <br /> In the event that any part of this by-law is declared void for any reason, <br /> by any Court of competent jurisdiction, the remainder thereof shall continue <br /> �in full force and effect. " <br />
