Hanson, moved that the <br /> Executive Secretary be authorized to direct .the Paul Peter Agency- to <br /> include this policy in .the Town' s portfolio with., the effective date of <br /> July 1 , 1983. Seconded by Sel. Terry. Motion carried. <br /> . Board p g <br /> acce ted the resignation from Ernest Virgilio from the Regioiial <br /> Transit Authority with regrets .' Mr,. Virgilio as Superintendent of Streets <br /> stated that the involvements in the projects that he has for the 'down <br /> and the time needed for these projects was why he felt he had to resign. <br /> Board stated that they understood. <br /> o p.m.- Mr. Laycock and - all the .xeber's . of the Public works BuildingCom- <br /> mittee were here to discuss the problem with the language of -the <br /> contract with Atlantic Design and Construction Inc. <br /> Mr. -Laycock -is an architect representing-.the company.. <br /> mown Counsel explained that he .had received a letter stating that <br /> they agreed to four of the requests and obJe ted to two of them. <br /> `own Counsel suggested some modifications and- some -dialogue followed <br /> resulting in his requesting this meeting. <br /> Their first objection is they do. not want -to deliver ownership of <br /> the plans until job- is. completed. gown Counsel stated that he <br /> followed the state model when, preparing -the contract and they <br /> suggest that the. set of roproduceable . lie owned by the 'down apon <br /> the completion of Phase III . <br /> Mr. Laycock explained the company' s feelings on the matter. <br /> Discussion followed. <br /> The other objection is to the word arbitration, There ds no <br /> procedure to go to arbitration. More discussion on this .matter•. <br /> Mr. Laycock asked that the word inspect be changed to observe <br /> on page 8 or'. the 11th line. Town counsel said' that he sees no <br /> problem with that-. <br /> Board recommends that Town, Counsel and Mr. Myers ,, Atlantic Design' s <br /> Counsel. get -together to- modify the contract: and solve these pro- <br /> qP <br /> blems. Board- thanked everyone for coming. <br /> Motion by Sel. 'ferry to- adjourn the meeting-. Seconded by Sel. Hanson. Motion <br /> carried.
