F <br /> .f <br /> BOARD OF SELECTMEN <br /> 1 <br /> MI=S <br /> AD ]I NI STRATIVE MEETING <br /> =DAY, JULY 315 1984 <br /> 8:00 a.m. to 9:15 a.m. <br /> PRESENT: Chairman Hanson, Selectman Terry, Selectman Thomas, Executive <br /> Secretary, Joseph F. Murphy, Mr. Collins, Chief Frye, Nor. Boyd, <br /> and' ]onica 1cNally of the Enterprise. <br /> 1. The Board discussed with Chief Frye, Mr. Collins and Mr. Boyd the <br /> status of Mazzilli's fruit stand. It was noted the stand had a valid <br /> transient vendor permit and c'urrently was located at the parking lot <br /> of Dan and Bill's. <br /> It was noted that a vendor permit had been issued but that town by- <br /> laws regarding these permits were in need of revision. The new <br /> procedure should .include a sign-off process whereby the police <br /> department would contact the building inspector regarding appropriate <br /> zoning before issuing any transient vendor permits.. <br /> Additionally, Chief Frye was asked to propose a revision of the <br /> town by- law on transient vendors Section 4.5.11) . The chief <br /> stated his desire to have vendors at Dick & Ellie"s flea market <br /> have transient vendor permits as a result of an incident that <br /> occurred recently. He was aske .to include this in the proposed <br /> by-law revision. In the interim, he will ask Dick. Wasil to <br /> maintain a log of vendors. <br /> With regard to Mr. Mazzilli, it was Felt he was in violation of <br /> the zoning by-law. The building inspector was asked by Selectmen <br /> to take appropriate enforcement action. Town Counsel would b <br /> contacted for assistance. Similar enforcement action was directed <br /> at the other fruit/vegetable vendor operating on Route 28 across <br /> from Angelo' . <br /> 2. Selectmen thea discussed the rescinding- of Section 5.5 of the <br /> zoning by-law. A hearing will be held August 1 on the article o <br /> selectmen to go on the fall special town meeting. <br /> Mr. Collins expressed the opinion that in rescinding Section 5.5 <br /> would create a huge number' of petitions for variances so that the <br /> Board of Appeals would be forced- to meet nightly,. Additionally, <br /> Nor. Collins felt the change would create a hardship for out-of- <br /> state owners of large numbers of small lots. <br /> It was explained. that Section 5.5 was adopted during the Indian <br /> suit to protect developers who had a lot of small lots. <br /> Nor. Terry agreed to prepare a written statement for presentation <br /> to the Planning Board in support of the article. <br /> 3. ) The Board reviewed jury questionaires. <br />
