In fact, the town has as
previously stated, has already removed Mr. Aitchison from the
payroll , prior to the employment termination hearing.
On behalf of Mr. Aitchison, we object to these
request
reain
proceedings going forward at this date in time and again 9
m s
that a vote to continue be taken until such time a the March 5,
t
1985 hearing occurs. Action of this Boar in scheduling his
nue the same
refusing to conte , h s the effect of denying
hearing, re g
Mr. Aitchison 's rights to be represented y counsel as well as
denial of his right to due process of law and those rights
afforded him by the Massachusetts State Statutes.
Should you fail to heed this request, and go forward with
this hearing, additional legal expenses will be generated to
enjoin any votes of termination. Further, I believe that such an
action , causing Mr. Aitchison additional expense and emotional
distress, constitutes violation of those basic civil rights
afforded to him, guaranteed by the Constitution of the United
States of America as well as the laws and Constitution of the
Commonwealth of Massachusetts. Should Mr. Aitchison be forced to
take legal steps to protect his rights concerning a wrongful
termination hearing, it is his intention to file suit in the
Federal District Court in Boston against Willard H. Hanson,
Richard L. Terry and B. Jean Thomas, as individuals for violation
of his rights, for reimbursement of his damages, and for payment
of all additional attorney ' s fees that your refusal to continue
this hearing will force him to incur, all pursuant to 42 USCA,
Section 1983 as well as Massachusetts General Laws Chapter 12,
Sections 11H and 11I.
Therefore, in view of all of the foregoing, we strenuosly
object to these proceedings, shall not participate in the same,
and request they be postponed.
Cordia 11
• 6LGYt.
Edward E.
