Malone
The hearing which lasted approx to l.y twoand one half hours, was taped and
filed for reference.
Personnel Board's Thoughts and Reconenda tions are as follows:
Mr. Charles Cuthbert I sthoughts;
When a Police Officer has a call for such an in ,dent, he should be able to use
whatever he thinks his right at that particular time. He is liable to make a
mistake like anyone else and an arrest is not always he essa{ry because of
complaint.
He also stated that: no one else eem to of heard the "Vulgar"' language that
r. Bob Burns heard* If this matter was handled wit out a great fuss or d,ls
turba ce the action taken should of been sufficient.
Air. Cuthbert stated that the swear words are now a coon thing to gear in
most places. The matter seeme d to of been hand les properly and in adequate '
time which was about twentyinu to .
As for the assault, this was not quite meant as one.
r. Cuthbert also s to ted, that the officer disposed of this s i tua tion W th
good judgement which could of been an explosive matter.
Mr. John a lone's thoughts
When a man is in such a situation and is faced with a potential problem of
an allmo t assault n himself, he should of called for a si tanc g and 6f
he felt there was groung for arrest in that bar at that time, he should of
then mond for help and made the arrest.
. Malone stated that officer Thomas was alone for a time but, should of
followed Police Procedures that is; take him outside and arrest him. '
As seeing what Officer Thomas did, Mr. Malone stated, it was poor judgement
and detrimental to the Police Force and Police Officer.
Mr. William lendenin' thoughts:
Mac. Cl. ndenin s to ted he has seen 'this typo of situation many times in different
places and the young man must f this
disturbance.
Officer Landers has s to ted that he heard swearing etc.
Mr. Clendenin stated that officer 'Phomas should of asked lir. Burns to clear the
place and then made the arrest as expected from an officer.
Mr. Cl. ndenin also said that when a Police Officer enters a place for such a
16 reason, he should be firm and positive in his action and duties but, officer
Thomas seemed of appeared frightened.
