In a. memorandum dated June 17, 1987, <br /> the Executive Secretary noted that an article has been prepared by <br /> Counsel for inclusion on the warrant of the July 27 , 1987 Special <br /> Town Meeting regarding the acceptance of 'Deerfield Road, Blair <br /> Circle , and Alden Circle . The Planning Board has been asked to <br /> schedule a. public hearing, Emphasizing that this action should <br /> not be seen as a precedent, Mr. Iawrenc e moved that the' Board - <br /> author'i e that assessments be cone by lot for the Deerfield Road <br /> pro ect only, lir. Gottlieb seconded the motion. The vote was un- <br /> animous , <br /> n-animus . <br /> APPOINTMENTS AND HE RI GS : (cont. <br /> 2. Pox Run Condominiums relocation of three public <br /> W a s . Kevin Me - Kirrane : Esq. was present to review proposed plans <br /> filed in conjunction with the overall development of the former <br /> Fox Run development project, Mro Kirrane , representing Daniel C. <br /> Hostetter, was seeking approval from the Board for the relocation <br /> f Quippish Road, Simon's Road , and Bryant's Core Road, Mra Kirrane <br /> outlined this subject in his letter of Juno to, 1987. r. Kirrane <br /> stated that the plans and the special permit have been approved by <br /> the Planing Board as well as a cluster sub-division plan which was <br /> an integral part of the over-all plan. One of the proposals called <br /> for the relocation of the ways noted above which are "u improved for <br /> the most part, but which are open to the public ,, " I r. Kirrane dis- <br /> played <br /> ispla ced three plan8 depicting the subject ways and remarked , "I have <br /> not sent those specific plans to the Planning Board in conjunction <br /> with this application , but it's my understanding that those plans <br /> were a. part of the package that was submitted to the Blaming Board <br /> in con unction with the approval of the special permit and the cluster. " <br /> Mira Kirrane demonstrated on displayed plans the proposed relocation <br /> of the subject ways . Referring to the plans , Mrs . Thomas said., "when <br /> I looked at the maps , I did not see that Bryant's Core Road was really <br /> indicated on how it's going to be laid out. " r. Kirrane was not <br /> able to show the exact relocation onplans presented at -this hearing. <br /> Mrs . Thomas read Chapter 82 MILL, noting .its pertinence to this hearing, <br /> which is the relocation of ways open to the public pursuant to the <br /> provisions of Chapter 82. Referring to Jill Slaymaker, Mrs . Thomas <br /> said., ",You have one abutter that may. or may not be aware of the re-. <br /> location of the roads"' To which Mra Kirrane replied, "No-' mutter <br /> has conata.ct ed me raising. an. issue of- lack f-, awareness of `the* re- <br /> location t of. a y roa ' _o <br /> All abutters should have been notified in con- <br /> junction with the Planning process in the special permit application <br /> and the cluster approval so that abutters would receive notice in <br /> conjunction with the procedure that went through the Flanning Board <br /> and an integral part of what took place before the Planning Board <br /> called for the minor deviation of the relocation of a portion of these <br /> ways . . .because it's clear on the plans . It is clearly demonstrated <br /> on the plans that were submitted before the Board where the existin <br /> g <br /> roadways were and how they would be relocated" . In response to a. <br />
