MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION TO SPECIAL PERMIT (SP-2012-30) <br /> Mary E. Zocchi, Trustee <br /> 9 Ockway Bay Road (Map-99 Parcel 49) <br /> Mashpee, MA 02649 <br /> SP-2018-31 <br /> Chairman Furbush read the email from Drew McManus into the record dated June <br /> 29, 2018 stating the order of conditions for the dock is valid until July 10, 2019. Mr. <br /> Furbush also read the email sent from the Harbormaster, dated June 27, 2018 stating he has <br /> no issues. <br /> The Board read the Board of Health comments into the record. The Inspection <br /> Department comments were read into the record at the last hearing. <br /> Mr. Furbush commented to the Board that the condition was that the dock could <br /> not be started until there was an occupancy permit issued for the house. He has no issues <br /> as long as there are no changes made to the dock. <br /> There were no abutters present. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> modification to a Special Permit. Upon motion duly made and seconded at the Public <br /> Hearings on Wednesday, July 11, 2018, the Zoning Board of Appeals voted unanimously <br /> to issue an extension of the Special Permit (SP-2012-30) with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 9. <br /> 2. Site Plan —Site Design Plan, Owner of Record: Mary E. Zocchi, Trustee, Zocchi <br /> Realty Trust, 416 Beacon St., Boston, MA., 9 Ockway Bay Road, Mashpee, MA. <br /> Sheet 1 of 2,Date: 06117112, Scale: V=30', Dwg File: OCKWAYBAY 9, Design <br /> by: DF, Checked by: Christopher Costa, PLS, Prepared by Christopher Costa & <br /> Associates, Inc. <br /> 3. Conditioned upon all Town Department comments read into the record. <br /> 4. Condition upon a certificate of occupancy for the new home must be issued <br /> before the dock is started. <br /> 5. The Board also extends the date of issuance of the Special Permit SP-2012-30 two <br /> years to the date of July 11, 2020. <br /> 2 <br />
