(Owners of record: Sherri and Robert Stivaletta). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on June 1, 2018 and June 8, 2018 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 27, 2018 at which time the following members of the Board of Appeals <br /> were present and acting throughout;Chairman,Jonathan Furbush,Vice Chairman,William <br /> Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Associate Member, Brad <br /> PittsIey. Also present was Building Commissioner, Michael Mendoza. <br /> Mr.Augustine Lett,3 8 Crestview Drive,Falmouth,MA represented the applicant's <br /> petition requesting to build an extension of a deck from 4 ft. to 7ft. to allow more space <br /> from the front door. The extension is getting too close to the property line. <br /> The Board wanted to confirm the current setbacks of the current and proposed deck. <br /> They confirmed that from Cotuit Road, the setback is 33.4 ft., the side setback is 42.5 ft., <br /> and the back is 45.7 ft. The existing lot coverage is 12%. This is a pre-existing non- <br /> conforming situation where he is extending a non-conformity. The front yard setback is <br /> being increased to an additional 3 ft., which is the reason for the Written Finding. <br /> Mr. Lett said the deck is 4 ft. wide in the front and will be extended another 3 ft, <br /> getting closer to the lot line. The stairs are being squared off and do not count as lot <br /> coverage. <br /> 1 <br />
