Diggins Ct£: #208213 <br /> 56 Canonchet Avenue <br /> (Map 56 Parcel 120D) <br /> Mashpee, MA 02649 <br /> A Petition was filed on March 29, 2018 by Scott M. and Tracey Diggins requesting <br /> a Variance under §174-31 (Land Space Requirements) to vary the rear and side yard <br /> setbacks to allow for construction of a detached garage on property located in R-3 Zoning <br /> District, 56 Canonchet Avenue,Map 56 Parcel 120D, Mashpee, MA. , <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on April 6, 2018 and April 13, 2018 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 9, 2018 at which time the following members of the Board of Appeals <br /> were present and acting throughout;Chairman,Jonathan Furbush,Vice Chairman,William <br /> Blaisdell, Scott Goldstein, and Associate Members, Brad Pittsley and Norman J. Gould. <br /> Scott and Tracey Diggins represented themselves for their Variance application for <br /> a detached garage. The wanted to set the garage on the right hand side of the house for easy <br /> access. <br /> At the first hearing on April 25, 2018, the Board told the applicants that the garage <br /> Will be too close to the side lines, and requested the applicants to confirm with the Board <br /> of Health the location of the garage with the distance to the septic system. The Board <br /> wanted to confirm that there is a hardship. The Board asked the applicants to return at the <br /> next hearing with a more specific determination from the Board of Health. <br /> The Board read the Board of Health Comments into the record; "BOH Comments: <br /> A septic inspection is required due to change offootprint(or addition ofgarage which will <br /> take up additional land for possible septic use). The septic inspection report shall be <br /> provided to the BOHprior to Building Permit approval. " <br /> 1 <br />
