(Owner of Record: Janet <br /> Shemligan, Trustee). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on April 20, 2018 and April 27, 2018 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 9, 2018 at which time the following members of the Board of Appeals <br /> were present and acting throughout; Chairman,Jonathan Furbush,Vice Chairman,William <br /> Blaisdell, Board Members, Ron Bonvie, Dom DeBarros, and Scott Goldstein. <br /> Mr. Leo Roias with ProGroup Contracting represented the homeowner for deck <br /> repairs of the existing deck. He said his client wants to use the existing frame and put new <br /> railings and decking. Upon inspection of the deck, Mr. Roias found the frame was not <br /> conforming to current building codes. When he tried to apply for the permit, the Building <br /> Department told him that the lot is non-conforming and would need a Zoning Board <br /> application. Mr. Roias said he is not changing the size or shape of the deck. The deck <br /> footprint will remain the same and it will be re-built to code. <br /> The Board read the Conservation comments into the record; it is not in wetlands <br /> jurisdiction. There were no comments from Board of Health. <br /> The subject property located at 22 Pembroke is approximately 9,017 square feet. <br /> There were no abutters present. <br /> 1 <br />
