Town of Ylashpee <br /> 16 f73 rcpt=�ii>e�.l�rracl f0°ij3 tl� <br /> Alashpoe,Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> V-201.822 <br /> The Goldberg Family Nominee Trust Bk.: #30965 <br /> 168A South Sandwich Road Pg.: #140 <br /> (Map 21 Parcel 9) <br /> Mashpee, MA 02649 <br /> A Petition was filed on March 28, 2018 by The Goldberg Family Nominee Trust <br /> requesting a Variance under §174-33 to allow for reconstruction of an existing deck <br /> situated within the 50 ft.'buffer wetland resource area on property located in R-5 Zoning <br /> District, Map 21 Parcel 9, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on April 6, 2018 and April 13, 2018 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 25, 2018 at which time the following members of the Board of Appeals <br /> were present and acting throughout; Chairman,Jonathan Furbush,Vice Chairman,William <br /> Blaisdell, Board Member, Scott Goldstein, and Associate Members, Brad Pittsley and <br /> Norman J. Gould. <br /> Mr. Tim Santos,with Holmes and McGrath represented the applicant. The property <br /> is located at 168A South Sandwich Road. The subject lot is a 34 acre parcel that runs from <br /> South Sandwich Road to Mashpee Pond. The single-family home was built in the 1970's <br /> and is located on the wetland resource area known as Mashpee Pond. The applicant is <br /> seeking a both a Written Finding and Variance to reconstruct the deck along the rear of the <br /> house. The deck will be reconstructed within the same footprint. The project has gone <br /> through Conservation and was approved and issued an Order of Conditions. The applicant <br /> will also be changing some windows and doors. <br /> The Board reviewed the plans and wanted confirmation that the project was for the <br /> rear deck attached to the house. They did not see any issues. <br /> The Board read the Inspection Department, Conservation and Board of Health <br /> comments into the record. <br /> There were no abutters present. <br /> 1 <br />
