(Owner of record: Joseph M. Biknaitis). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on March 9, 2018 and March 16, 2018 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpec Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday <br /> April 11,2018, at which time the following members of the Board of Appeals were present <br /> and acting throughout; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members, Scott Goldstein, and Associate Members, Brad Pittsley and Norman J. <br /> Gould. Also present was Building Commissioner, Michael Mendoza. <br /> Attorney Kevin Kirrane represented Mr. Coffee who is the potential owner of the <br /> property and was also present. Mr. Kirrane provided a written narrative, and plans that <br /> explained the zoning history of the lot,and if in fact the lot was held in common ownership <br /> between 1971 and 1981. <br /> Mr. Kirrane explained to the Board the uniqueness of the neighborhood plan. He <br /> said that the Planning Board approved the plan in 1981, the zoning had changed in 1979 <br /> when this particular parcel was placed in an R-2 zoning district as opposed to an R-1 zoning <br /> district. In 1979, the map changed and the frontage requirement was 125 ft.,not the 100 ft, <br /> that the lot had. At the time, the Planning Board executed an Approval Not Required, <br /> (ANR)which suggests that the lot had adequate frontage on the road,and sufficient acreage <br /> to qualify for building purposes. <br /> 1 <br />
