MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> Edward Coffey <br /> 31 Amy Brown Road (Map 109 Parcel 5) <br /> Mashpee, MA 02649 <br /> V-2018-14 <br /> VARIANCE CRITERIA: <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Variance. Upon motion duly made and seconded at the Public Hearings on Wednesday, <br /> April 11, 2018, the Zoning Board of Appeals voted unanimously to issue a Variance with <br /> the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Variance <br /> under Mass General Law 40A Section 10. <br /> 2. Site Plan —Joseph M. Biknaitis, PO Box 448, Mashpee, MA, Sewage Disposal <br /> System Design, 31 Amy Brown Rd, Mashpec, MA. Sheet I of 1, Date. 611115, <br /> Drawing File Name: AMYBROWN_31_BIKNAITIS, Drawn by: MC, Checked <br /> by: MC, CC, Prepared by: Cape & Islands Engineering, Drawing Title: Septic <br /> Design Plan, Signed by Matthew C. Costa No. 1388, Land Surveyor. <br /> 3. The Board issues a Variance based on their request of 50 ft. of frontage, 11.2 ft. <br /> from the front setback, and 3.8 ft. from the rear setback. <br /> 4. Conditioned upon all Town Department comments read into the record. <br /> 5. Amy Brown Road is not a Town accepted road until the road is brought up to Town <br /> standards. No Town Departments are responsible for any drainage issue(s) and is <br /> the responsibility of the residents of Amy Brown Road. <br /> 6. The residents of Amy Brown Road will need to maintain Amy Brown Road. All <br /> drainage will be controlled and maintained by the residents of Amy Brown Road. <br /> 7. An occupancy permit will be issued after the Fire Department approves the road <br /> upgrades with a signed letter to the Building Commissioner. <br /> 3 <br />
