Napoli Book#: 4401 38 Treasure Lane Page#: 104 (Map 96 Parcel 67) Mashpee, MA 02649 A Petition was filed on January 9, 2018 by Owner, Dennis Napoli requesting a Variance under§174-31 of the Zoning Bylaws to vary the front yard and side yard setbacks to allow for an addition to an existing covered porch and deck on property located in an R- 3 Zoning District, 38 Treasure Lane, Map 96 Parcel 67, Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on January 26, 2018 and February 2, 2018 a copy of which is attached hereto and made a part hereof. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, February 14, 2018 at which time the following members of the Board of Appeals were present;Acting Chairman, William Blaisdell, Board Members,Ron Bonvie, Dom DeBarros, and Scott Goldstein, and Associate Member, Norman J. Gould. Also present was Building Commissioner, Michael Mendoza. GENERAL CRITERIA: The subject property located at 38 Treasure Lane is approximately 10,035 square feet. There were no abutters present. The Board read the Town Department comments into the record. VARIANCE CRITERIA: Chapter 40A: Section 10. Variances: The authority specifically finds that owing to circumstances relating to the soil conditions, shape, or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located, 1
