Continue Review of Action Items List(continued) See-4- —Rental and U e of Proper. Scott McGee said he feels the attorney paraphrases it perfectly in this January 8, 2014 letter. The School Board feels it is important to have an MMU going forward, Don Myers added that h feels the agreement should be"softened"to take into account it is a delegation of the School Committee"s authority to the Town Manager. Action: Leave on attorney list to ask attorney about exact wording. Sec 4-2(k)—Chief procurement officer. Delete from Action List...attorney answered the questiont Sec 44c)-Powers and Duties of Acting Town Manager. This section designed to leave positions open until new Town Manager appointed; however this leaves a gap because not making any permanent appointments or designations. Consensus of Charter Review Committee is to-have the Board of Selectmen authorized to make appointments permanent during any vacancy in the office of the Town Manager. Sec 4-5a)—Removal and Suspension. Last sentence of this section reacts; "A copy of the resolution shall be delivered to the Town Manager forthwith." Question: Khat method of delivery, i.e. regular mail,electronically,bulletin board,website,etc' Action: Attorney should define`delivery method". Sec-5-T b —Administrative Code. Committee reviewed and discussed the response in the January 8 letter. Action: Committee needs further clarification from the attorney. See-5-4—Review of Appointments by Board of Selectmen. Delete from Action ist...attorney answered-the question. Sec 7-8b)—Rules and Journal In his January 8'h letter,Pat Costello-suggested the following language be substituted for the last sentence of Sec 7-8(b)to address Committee's concerns,yet maintain the discretion of the Town Clerk per General Bylaw 7-5: "subject to provisions of applicable lave and bylaws relative to the administration of public records,all multi-member bodies shall file with the Town Clerk all roles and journals, including all revisions and amendments thereto,forthwith upon adoption thereof. In the event of any discrepancy between the certified copies of rules and journals on file with the Town Clerk and the original documents on file with each respective multiple member body,the original documents shall be deemed to be the "official"version thereof'. Action: Leave on attorney list. State Pat Costello's language publicly on the record and look at aspect of viewing electronic("virtual board") copies of documents.
