Review of Charter Sections on Action'Lists a ntinued <br /> See-4-2(b) ointments made by Town Manager <br /> Attorney Costello clarified that appointments are made by Town Manager but are not final or <br /> implemented unless and until confirmed by the Board of Selectmen. However,the Board of <br /> Selectmen can only do'so after the Town Manager has made the initial apps intinents. He said the <br /> Board of Selectmen cannot select its own candidates , so Burd of Selectmen can't say"n "to <br /> " ";we want" ". wane Taylor said the Board of Selectmen can certify the press was <br /> followed but can still deny confirmation. Attorney Costello responded"yes". <br /> Attorney Costello said the language used in M shp a Town Charter in this section is fairly <br /> standard and common language in charters. He said this particular section relates to.department <br /> heads,town officers,and members of multiple member bodies for whom no other method of <br /> selection is provided by the Charter. Attorney Costello explained the other certification provision <br /> relates to all neva Town employees. <br /> See-4-2(g)-Rental and Use of Prop rt . <br /> Scott McGee said nothing needs to be in the Charter,but we don't have an MOLD between School <br /> and Town. Attorney Costello said it would beboove everyone to have something in writing in <br /> -place. <br /> Action: Charter language suitable as is. <br /> Sec - .e -Powers and Duties of Acting Town Manager. <br /> Attorney Costello said the intent of this section is very dear. He said it is gap filler. The gap is it <br /> is only temporary. The intent is the Town Manager should have final say. Motivation for Board <br /> of Selectmen to act. <br /> Sec - a —Removal and Suspension. <br /> Last sentence of this section reads: "A copy of the resolution shall be delivered to the Town <br /> Manager forthwith." Attorney Costello said"forthwith"means as soon as possible,as well as <br /> practical. He said it is a commonly used legal term. <br /> Sec- -l(b) Administrative Code. <br /> Attorney Costello explained that if Town Meeting takes no vote,thea in 30 days the plan of <br /> organization submitted becomes effective. If Tern Meeting votes and does not pass the plan, <br /> then the plan does not proceed. If Town l eting votes to`table"and tabes no action,thea in 30 <br /> days the plan of organization becomes effective. <br /> See-5-4—Review of Appointments by Board of Selectmen. <br /> ttorney Costello said this is a procedural recluircment. .Board of Selectmen limited to <br /> confirming that Town policies and procedures relating to the hiring have been properly followed <br /> and that there is ars appropriation available. <br /> dee-7- charter.levier <br /> Attorney Costello confirmed that the Board of Selectmen can decide to have Charter review at <br /> any time within 1.0 years,but must do so every I ' re rs. <br /> pec-7- b — -Law Review <br /> Deb Darin said they published for a By-Law ReviewCommittee but to no avail. Attorney <br /> Costello said if you can't est fish a committee,a good faith attempt was macre to comply. Don <br /> Byers suggested perhaps By-Lav Review should be charged to at least once every 10 years. <br /> Action: Charter Review to discuss further. <br />
