i IABHPEE HIGH SCHOOL BUILDING OMMITTEE MONDAY , APRIL 24 , 1995 TOWN HALL P resent: Joe Polito, Steve ree l i sh , Bill Martiros , Merry Sue Ah l g ren , Paul Griffin , Peter B i n ii o Also Present : Ian Aitchison , Tori Wren , Joel Seeley Meeting convened at 4: 12 p .m. Everyone welcomed Bill Mart i ros back . The Committee will vote on the minutes next week , because they just received them today. Because there were many people in the audience, Paul asked thea to introduce themselves and the. firms they represent. Paul first explained to the Committee ghat had transpired this past wee and suggested thea they listen to the comments of the visitors . Paul explained that the low bidder, Stone, asked for a 10 day waiver to meet their minority participation requirements . As of today , they have met those requirements , Town Counsel sees no legal ob'ection to awarding this contract to Stone . The Town has re ee i ve drate s is - from Eastern Contractors (second lowest bid) , are protesting the 10 day waiver . - TLT has an objection to the first 2 low bids , but Paul does not understand their point , because that would not make them low bidder . They are the low bidder only if the Committee were to take only the first alternates. The Committee has recommended taking all 10 alternates Paul explained that Eastern chose Argat (masonry ) for an extra $250 , 000 . Had they not carried them , - Eastern would be low bidder . The did it to meet their minority requirements . Town Counsel has said whatever they filed , that i s i t. On the Farm it clearly stated , regarding the minority requirement: - you could submit all the information up front. - request a permanent waiver,. -- request a 10 day extension . It was up to each bidder how they would meet this minority requirement. it is a hone rule form, generated by the Town of Mashpee . It is up to this Committee and to the Selectmen to decide if they accept Stone' s request for a 10 day extension . If it i s accepted , the next step is clear. If it is not accepted , then the Town must disallow their bid . Paul has discussed this in great detail with Town Counsel . Mashpee gave thep rov i s i on for the waiver , it would be unfair not to accept i t . If you don ' t accept i t , h ashpee should eliminate it from the fora.
