That is correct. <br /> Stone did meet their requirements within the 10 days . <br /> Deter asked -if all the -facts were checked? <br /> Paul said Town Counsel suggested the Committee vote , subject to Town <br /> Counsels review of al 'i the facts . <br /> Audience Comments : <br /> David Gomes , represents the bricklayers union local 3 . He said if the Town <br /> awards this contract to Stone , they are going against the grain of the <br /> prevailing wage law, which is to make it fair . <br /> Stone had only 1 /4% of the requirement when they submitted their bid . <br /> Paul said if they get to the 10% requirement, why should the Committee care <br /> how they did? <br /> Mr . Gomes asked what good faith effort did Stone make? <br /> Paul said , in talking with Town Counsel , the minority requirement: is a <br /> "local requirement, the Selectmen have the right to totally through it out, <br /> they don ' t have to honor it. The form allowed for a 10 day extension . If <br /> the contractor fulfills that requirment, they have met the intent of the <br /> Town . This Mashpee form is far stronger language then any other community <br /> in the State , Paul said he is not going to scrutinize how they get to it <br /> (meet the requirement) . <br /> Mr . Gomes said he reviewed the bids on Monday and did not see , in writing , <br /> where Stone requested the waiver . <br /> His point is that each and every contractor could have filed out this <br /> waiver without putting their numbers on the table. The other contractors <br /> put it on the table in good faith . You allowed Stone to shop this job out , <br /> which is unfair . <br /> Paul said he will take those comments under advisement. He has spoken to <br /> Town Counsel on this issue and they carefully reviewed all the facts . <br /> Ed Roster from Bacon Construction, he said they should have received a <br /> protest from Bacon . He said a fifth addenda came out, allowing for this 10 <br /> day wavier and he feels that is an unfair way to do it . The other <br /> contractors submitted their bids based on the original specifications . <br /> Those contractors were then at an disadvantage . You gave 10 days to the <br /> people who did not do their homework . The •Fifth addenda made it unfair . <br /> Lynn Donohue, from Argat , said she has been a bricklayer for 18 years . <br /> Her ' s 'is a legitimate woman owned business . The low bid is the only one <br /> who had a waiver for the m'inor'ity/woman participation . In cases like this , <br /> this is when games are played by the contractors , they are able to shop <br /> around. Everyone should have waived it. She said as a subcontractor , she <br /> never received an addenda #5 . <br /> There were 4 contractor's who were totally in compliance and the only one <br /> who was riot in compliance is rewarded . <br /> Her company has done excellent work ort -the Cape , they are working on a show <br /> piece now 'in Barnstable . They have done 3 buildings in Mashpee . When you <br /> go about it this way , asking for an extension and riot complying, this is <br /> 2 <br />
