He explained to Stone that the torn is not <br /> backtracking from the process they have initiated. This natter must either be resolved, or the <br /> town will terminate the contract and deal with the consequences. <br /> If the town chooses option 1,to negotiate to resolve the natter,there are 3 items to address: <br /> - identify uncomplete or unsatisfactory work that can be completed in the short term -by the end <br /> of February school vacation. <br /> - Stone produces a concrete schedule., <br /> items of work that cannot be completed in the short term(landscaping and fields) an agreement <br /> is reached on what Stone will do to complete there or Stone gives the town the value of that <br /> work. <br /> We will of course disagree on certain items and we will then have to arrive at a mutually <br /> acceptable credit for those items. Jim Rudnick had earlier suggested that a mediator should get <br /> involved. Pat Costello said the town will consider that only in the short tern. <br /> Damages: Pat Costello seat a letter to Stone with a breakdown of the damages dealing with the <br /> delayed opening of the school <br /> All of these issue have to have a written agreement and if there is a breach of that agreement, <br /> default will be declared immediately. <br /> The second option to the torn is to declare default and terminate the contract. <br /> The Town would like to hear from Stone as to what they intend to do to complete this job. <br /> Bob Lia, attorney for Stone, said clearly the course Stone wants is the first option,to have a <br /> complete pro f ect and negotiate a resolution of re aiming issues. He explained that Jim Johnson, <br /> who will speak to the representatives of the town here today, plans to satisfy Stone"s obligations* <br /> Mr. Johnson just joined the company. He has spent a few week getting up to speed on this <br /> situation, His sole mission is to close out this contract. It s a toppri ority for Stone to get this <br /> job done, fir. Li a.went on to describe Mr. Johnson"s credentials. <br /> 1r. Lizza added a few points to this discussion: <br /> - Stone grants to develop a cooperative work environment going forward. Mr. Johnson will <br /> explain what he thinks needs to be done to make that happen. Stone will rededicate itself to that. <br /> - punch list: Mr. Johnson will tell us their plan to complete it. They have special plans for <br /> February vacation, <br /> 1 <br />
