MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 14, 201.8 <br /> The final sentence of Bylaw §174-17.1 states in no case shall any new non-conformities be <br /> created with respect to any replacement structure without the issuance of a Variance or take <br /> any action related thereto. <br /> If the new bylaw does not pass,there will continue to be very few raze and replace projects <br /> in Mashpee. One can only imagine the amount of tax revenue that the Town will not <br /> generate, and the jobs lost in the trades. This effects most architects, developers, builders, <br /> electricians,plumbers, and framers. <br /> Mr. Furbush announced that he will take public comments from Town residents after the <br /> Board members speak. <br /> Board Member, Scott Goldstein read the entire proposed Bylaw §174-17.1 into the record, <br /> and will be submitted for Town Meeting. <br /> Mr. Goldstein announced that he has been a resident and a builder with the Town over 25 <br /> years. He said 90% of his work is located in the New Seabury and the Popponesset area <br /> and he is very familiar with most properties in this area. He said since he has been a Board <br /> Member, the Zoning Board is very strict with the 20% lot coverage requirement. He has <br /> been hearing from folks of the misconception that this bylaw change will allow builders to <br /> build larger homes on these lots; this is not the case. He said he joined the Board so he <br /> could protect the homeowner and the builder equally. He said the purpose of this new bylaw <br /> is to "clean up" the wording so the Board can continue to accept raze and replace <br /> applications on most lots. He is hoping to get the support from the residents of the Town <br /> to approve this new bylaw. He continued to say that there is not much industry in the Town, <br /> and if the new bylaw does not pass, it will effect a lot of people who are in business for <br /> themselves, whether working in construction, building, maintenance, painting, <br /> landscaping, who make a living on new home construction. He also pointed out that the <br /> new bylaw will increase the tax revenue for the Town. He said that the current bylaw is <br /> outdated and does not follow the current building code standards. <br /> Mr. Furbush interjected and said a new bylaw was passed at the last Town meeting that <br /> allows 25% lot coverage for the lots under 10,000 sq. ft. which are mostly small cottages. <br /> But the key is that no applicants are allowed to go over 20% lot coverage. <br /> Board Member, Mr. Gould commented that bylaws are living documents and need to be <br /> updated to address the realities of life. <br /> Mr. Carl DeLorme, a resident and builder in Town spoke and agrees with what Scott <br /> Goldstein said; that it's important to protect both the residents and builders of the Town. <br /> The new bylaw will afford the residents and builders the opportunity and level of protection <br /> that is necessary to live and work in Town. <br /> 2 <br />
