9 <br /> Board of Selectmen <br /> Minutes <br /> August 6, 2018 <br /> NEW BUSINESS <br /> Discussion and Review of Draft#1 October 15 2018 Town Meeting Warrant: (continued) <br /> Discussion followed with respect to Article 48 to adopt a bylaw to prohibit the operation of recreational/non- <br /> medical marijuana establishments and marijuana retailers within the Town and Article #9 proposed to adopt a <br /> zoning bylaw amendment to limit the number of retailers in Town to fewer than 20% of the licenses issued <br /> within the Town for the retail sale of alcoholic beverages not to be drunk on the premises under M.G.L. <br /> C. 138, Section 15 and restricting the location of marijuana establishments to the Industrial (1-1) District <br /> as a special permit use. <br /> It was agreed the Board would obtain clarification with regards to the exact number of licenses that would <br /> be permissible with the current (11) liquor licenses in the Town of Mashpee. With regards to the <br /> potential location of marijuana establishments commercial and retail areas were considered for visibility <br /> purposes, and to maintain full advantage of the potential tax revenue. <br /> Motion made by Selectman Cahalane to allow the proposed marijuana establishments to be <br /> sited in the Industrial, Commercial and Retail Districts of the Town of Mashpee. <br /> Motion seconded by Selectman O'Hara. <br /> VOTE: 3-2. Motion carries. <br /> Roll Call Vote: <br /> Selectman Sherman,yes Selectman Cahalane,yes Selectman Gottlieb, no <br /> Selectman O'Hara,yes Selectman Cotton, no Opposed, (2) <br /> LIAISON REPORTS <br /> Assembly of Delegates: At a recent Assembly of Delegates meeting it was disclosed that well water <br /> testing is available at the county level to Cape residents. <br /> Planning Board: Regarding the Form-Based Code, it was disclosed that Arnold Chase of Mashpee <br /> Commons LLP has announced that work is ongoing, and it is hopeful an article would be ready for the <br /> May 2019 Town Meeting warrant. <br /> Cell Tower: The Cape Cod Commission has scheduled a Public Hearing on Monday, August 20 on <br /> the proposed cell tower. It was noted the Planning Board referred the project to the CCC because of the <br /> height requirements. It is anticipated there may be a great deal of comment from the nearby <br /> subdivision. However, it was agreed in the matter of public safety reception is needed in this area of <br /> Mashpee. <br /> Human Services: The monthly drop-in night is held on the first Tuesday of each month at the Mashpee <br /> Public Library. The substance abuse program has been very successful. <br /> Mashpee Unity Night: The National Night Out with the Mashpee Police and Fire Departments is <br /> scheduled to be held on Tuesday. <br />
