Town of Mashpee - Board of Selectmen Executive Session Meeting Minutes—Mashpee High School, Room D 11 May 4, 2009 -6:00 p.m. Members Present: Terrie Cook, Chuckie Green,,Wayne Taylor Members Absent: John Cahalan ,Don Myers Others Present: Joyce Mason,Town Manager; Rene' J.Read,Asst.Town Manager;Patrick Costello,Esq. I CALL To ORDER In the absence of Ch. Cahalane, Vice Chairman Taylor, acting as Chair, called the. meeting to order at 6.-08 p.m. 11 DISCUSSION PERTAINING To PENDING LITIGATION -A MOTION N was made by IVIS. Cook, and SECONDED by Mr. Green to enter into Executive Session for the purpose of discussing pending litigation. Ch. Taylor called four a roll call vote:Cook, Green and Taylor voted "aye" in'favor of the motion; motion carried. Town Manager Joyce Mason provided the Board members with a copy of the Draft Mutual Settlement Agreement and General Release in re: the Estate of Dominic laianotti and the Town of Mashp e. Ms. Mason noted that settlement agreement, the- terms of which were all confidential, contained a settlement amount of$12,000 and a provision that the complaint would be withdrawn with prejudice. Mr. Costello explained that by having the complaint withdrawn with prejudice, the Estate would wive its rights to re-assert the claim at a later time. MOTION was made by IVIS. Cook, and SECONDED by-1 r. Green to authorize the Town Manager~to sign the agreement on behalf of the Town of Mashpe . Ch. Taylor called for a roll call vote: Cook, Green'and 'Taylor voted "aye" in'favor of the motion; motion carried. There was no further discussion on the matter. i III ADJOURNMENT MOTION was made by Ms. Cook, and SECONDED by,Mar. Green to adjourn the meeting. Ch.
