4 <br /> 1� <br /> Board of Selectmen <br /> Minutes-Executive Session. <br /> April 12, 2010 <br /> Present: Selectman Myers, Selectman Cook, Selectman Cahalane, <br /> Selectman Taylor, <br /> Town Tanager Joyce Mason <br /> Absent: Selectinan Richardson <br /> Attendees: Town Counsel Patrick Costello <br /> Community Preservation Act Committee members; <br /> Wayne Taylor, Ed Larkin, Evelyn Bu chenfeldt, Tom O'Hara, Frank Lord <br /> Meeting Called to Order by Chairman Myers at 6:33 p.m. <br /> Town Hall, Conference Room#1 <br /> Discussion relative to the acquisition of real property: <br /> The Mills Family Lands at Sant it Pond: <br /> Town Counsel Patrick Costello updated the Board of Selectmen ars <br /> Co ,---iunity Preservation Act Committee on natters relative to The Mills <br /> Family Lands at Santuit Pond. <br /> In accordance with Special Town Meeting Article#11 approved by the <br /> voters of the Town of Mashpee on May 7,'2007,2007,the grantors are required <br /> to certify good and marketable title to the ubj ect property, free and clear <br /> of any and all liens, encumbrances, easements, clouds, and other third <br /> party rights or claims, upon such terms and conditions as the Selectmen <br /> shall deem to be in the lest interest of the Town, or take any other action <br /> relating thereto. The land consists of.1 5.24 acres, more or less, and <br /> in ludes portions of adjacent"paper" streets. <br /> Attorney Robert Mills, representing counsel for the Mills Family was <br /> reported to confirm a good and marketable title related to the subject <br /> property has been obtained. However, it was disclosed the existing <br /> abutters of lots deemed un-buildable to the Mills Family Lands maintain <br /> the right to cross the roadways or"paper" streets. Although.the actions <br /> taken by the Mills counsel reflect clear title there is an.acceptable risk <br /> thereof regarding the abutting property owners having use of the"paper' <br /> streets within. <br />
