The Board will re-convene <br /> in open Session at approximately 7*00 p.m, <br /> Motion seconded by Selectman Frye. <br /> YOT-E: Unanimous. 4-0. <br /> Roll Call Vote: Peter, yes Curtis, yes <br /> Fancy, yes Kenneth, yes <br /> George, absent <br /> Discussion relative to otential Lifigafiom <br /> The Board met with Town Counsel,Jahn for 'o to discuss the fins <br /> experience in hazardous waste litigation, and to assess the To d s legal <br /> options with respect to enforcing the Federal Facility Agreement covering <br /> remediation of the hazardous waste plumes emanating from the <br /> Massachusetts Military Reservation. <br /> It was noted that the Town is employing the services of Woodard& Curran <br /> to evaluation the MMR remediation project. <br /> Attorney Giorgio indicated that he is the head of the environment law <br /> practice of Kopelman and Paige, Town Counsel, and has represented <br /> many municipalities in the comprehensive Environmental Response <br /> Compensation and Liability Act R LA) and In 21E related matters. <br /> Selectman Dinizio indicated that testing has not occurred to date on the <br /> cast and south side of Ashumet pond. The government should be <br /> responsible to further test to define the extent of the contamination indicated <br /> Selectman Dini io who noted that the FS-1, another potential plume <br /> affecting Mashpce has not yet been addressed by the MMIC. <br /> Selectman Caffyn added that the Town is not satisfied with the overall <br /> process. The plumes have not been contained, and there is no solution <br /> for Mashpee indicated Selectman Caffyn who stated that the Town's <br /> reputation has been damaged* <br /> •r <br />
