The Commission may <br /> require proof (as it ems appropriatof the commercial nature of the <br /> agricultural enterprise(s) land purpo /d to be land in agricultural use. <br /> Upon the assertion n the partlofany person) that any portion of land <br /> qualifies as land in agdcultu use, the Commission may require the filing of <br /> a Request for Determination o Applicability to formally determine the status <br /> of said land as land in agricultu ase .e.. <br /> din agricultural use, said land must have <br /> Additionally, to qualify as�1 <br /> been in agricultural use prior t,6 the ' ception date of Chapter 172 (3-16-88), <br /> or if said land in agricultural use was onverted to agricultural use since that <br /> date, then said conversion must have n carried out as per the requirements <br /> of Section 2 of Chapter 172. <br /> Land in agricultural use may lie fallo for a period of time if it has been <br /> used for agriculture at any of the five ( immediately preceding years. <br /> Documentation of such use, as deemed necess by the Commission, may be <br /> required. <br /> (13) Normal maintenance of land in agricultural use shall ean the same as in 3 10 <br /> CMR 10.04, but shall NOT include 10.04 (Aa�ncultur1 (b)(1 1), "maintaining <br /> the flow of existingnatural waterways", <br /> y unless said terways (or portions <br /> thereof where alterations are proposed/done) lie entirel within the area of <br /> Land in Production" (as defined on p. 2-3 of"Farming in etland Resource <br /> Areas- A Guide to Agriculture and the Massachusetts We ands Protection <br /> Act", as cited above.) <br /> Page 19 <br />
