This decision was based <br /> , <br /> f <br /> solely on a report of alleged insubordination by Sgt. Gerald Umina on May 28, 1995. t <br /> i <br /> Until recepmw the notice I was not aware of any such incident on May 28, 1995. <br /> Jeanne Lortrionte called in sick, stating that her child was very ill. I advised Sgt. Umina t <br /> Of this and stated that I would start calling to see if I could find a replacement. when } <br /> I found that I could not fill the shift, I again informed the Sergeant. He said he would � <br /> come in and see what he could do. When he came in later, I told him of the results of <br /> A the calls. He thea requested the list of hone numbers which I ave him. Sgt. Umina <br /> � p � g <br /> came back into the dispatch area a short time later, and made the statement "You two <br /> talk it over and decide who will stay." Edward Finkle told Sgt. Umina that he refuses to <br /> work another shift. He was spending the day with his wife and was not sleeping. At <br /> this point I advised the Sergeant that I was already working a double. Having worked <br /> my other job <br /> and then the shift in Mashpee. A short time later Sgt. Umina called me <br /> on the phone, and said that he had Ed!s answer and wanted to know if I was going to <br /> work the shift. Iain explained to him that I had.been working since 07:00 that morning, } <br /> p <br /> and I was exhausted.. I felt that working a third shift until 08:00 the next day was nota <br /> good idea and would be unsafe for the town and the officers depending on me to be <br /> alert and aware. I felt that being asked to work a triple was very unsafe and I could E <br /> not do it. <br /> Later in the night, Gail.Mcdonald called in and said she could come in at 04:00 � <br /> of someone would call her at 03:00. <br /> Ed left work at midnight; and I remained an additional.forty-five (45)minutes, <br /> fmishins r <br /> x up the incident reports and entering the Emergency Restraining Orders into � <br /> the computer. e I advised Sgt. Umina that Deal Lotrionte had called <br /> p I�utYttg this time - . <br /> twice looking for Jeanne. I also showed him how to enter an incident into the computer <br /> r <br /> as he cid.not know exactly what to do. He made some notes for himself and said if <br /> he had any problem, he would just write it all down for entry later. <br />
