Przybylek; Chief of <br /> Police as presented. <br /> Motion seconded by Selectman Costa. <br /> VOTE: Unanimous. 5-0. <br /> Appointment of Assistant Town -Accountant: <br /> Application withdrawn. No action. <br /> LD BUSINESS: <br /> Finance Committee Court Case Discussion: <br /> Marcia King was present on behalf of the Finance Committee to <br /> request the Board approve Superior Court Action for Stipulation <br /> P <br /> of Dismissal. <br /> Ms. King indicated that the Finance Committee voted 4-1 in favor <br /> 0 <br /> of the agreement. The agreement and stipulation provides for resolving <br /> the open Meeting Law Complaint to the Barnstable District Attorney <br /> concerning the Finance Committee's meeting yof May 2, 1995. <br /> Stipulations as agreed upon include; the Open Meeting Law violation <br /> P g <br /> on May 2, 1995, the future compliance of the provisions of the open <br /> Meeting Law,requested dismissal without prejudice and that each <br /> party shall bear its own costs. <br /> The stipulation provides for the plaintiff to not furtherursue any <br /> Y _ <br /> request to the Barnstable District Attorney concerning compliance by the <br /> Finance Committee on the date of May 2, 1995. <br /> Ms. King indicated that the Finance Committee is now aware of the <br /> Open Meeting Law and of Executive Sessionilev <br /> ries. It was noted <br /> P g <br /> that the League of Women Voters will conduct a forum to discuss the <br /> laws in detail. <br /> Motion made by Selectman Mills to direct Town Counsel <br /> to move forward with the Stipulation of Dismissal as <br /> outlined, <br /> Motion seconded by Selectman Vaccaro. <br /> VOTE: Unanimous. 3-0. <br /> Selectman Costas Selectman Caffyn abstained. <br />
