MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> Wednesday, September 12, 2018 <br /> tl <br /> Ms. Sangeleer asked the Chair if this person wanted to speak on the hearing. Mr. Furbush <br /> said; no. <br /> Ms. Sangeleer read the Board of Health comments into the record. Mr. Blaisdell read the <br /> Conservation Department into the record. Mr. Gould read the Inspection Department <br /> comments into the record. <br /> There were no further comments from the Board. <br /> Mr. Furbush asked if there were any comments from the audience. There were no <br /> comments from the audience. <br /> The Board had a discussion if it was necessary to issue a Written Finding for this project. <br /> Mr. Kirrane said that the Variance and Written Finding could go hand and hand because <br /> the Board is making a substantial finding relative to the new structure that is being built on <br /> the lot, so the Variance relief is granted initially because the lot is under sized and lacks <br /> frontage. If the Board feels that the Variance relief is sufficient, or if the Building <br /> Commissioner will issue a building permit for the construction of a single-family dwelling, <br /> he said he could certainly withdraw. <br /> Mr. Goldstein made a motion to approve the Variance for Stewart and Barbara Dobson <br /> request Variance relief from frontage and lot size under §174-31 of the Zoning Bylaws to <br /> raze and replace a non-conforming dwelling on a non-conforming lot, and replace it with <br /> a conforming structure on the non-conforming lot on property located in an R-3 Zoning <br /> District, Map 125 Parcel 140, Mashpee, MA with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> VARIANCE under Mass General Law 40A Section 10. <br /> 2. Plot Plan—Existing House—Prepared for Stewart & Barbara Dobson, 162 <br /> Whippoorwill Circle, Mashpee, MA.
