MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> OCTOBER 10,2018 <br /> Ms. Sangeleer read an email letter,from Attorney Geoff Nickerson, of Oppenheim & <br /> Nickerson, LLP who represents the applicants requesting a continuance until the hearings <br /> dated October 24, 2018. <br /> Mr_ Bonvie made a motion to accept the applicant's request for continuance of 419 <br /> Monornoscoy Road referencing the Written Finding, continued until October 24,2018. <br /> Mr. Gould seconded,yes. All were in favor and accepted the continuance request. <br /> Mr. Bonvie made a motion to accept the applicant's request for continuance of 419 <br /> Monomoscoy Road referencing a Variance request, continued until October 24, 2018. <br /> Mr. Gould seconded,yes. All were in favor and accepted the continuance request. <br /> OTHER BUSINESS <br /> -Approve September 26, 2018 Meeting Minutes <br /> Ms. Sangeleer made a motion to approve the meeting minutes.Mr.Blaisdell seconded,yes. <br /> All were in favor. <br /> ADDITIONAL TOPICS <br /> Mr. Bonvie for the record as one member wanted to discuss when an applicant applies to <br /> the Board and has a ground water soil condition. He said for example if a leach field is in <br /> front of a home, and the bottom of the leach field is 4 or 5 ft. over that ground water. He <br /> believes an applicant can actually put fill in necessary to build a fill walk-out basement in <br /> a home. He said it is possible to install a-fall walk out basement in the back with a cross <br /> wall,and only have a 39 inch water table.His question is at what level does the water table <br /> measurement become an issue for soil conditions?He has an issue as one member agreeing <br /> to an issuance of Variance based on soil conditions. He would like some clarification for a <br /> legal standpoint. <br /> Mr. Mendoza believes there maybe court cases that decisions were granted on soil <br /> conditions. Chapter 40A under Variances mentions soil conditions. Examples are; too <br /> much rocks, ledge,or water. <br /> The Board discussed other concerns regarding the esthetics of a neighborhood if a septic <br /> tank and leach field are visible. <br /> Mr. Bonvie wants to consult with Mark Bobrowski regarding case law on this subject. The <br /> Board agreed to research case laws on this subject, and discuss sometime in the future. <br /> There were no further comments. <br /> 3 <br />
