+ A <br /> Comments from the public <br /> Theresa and Donald McCloud, abutters, were present. Theresa commented and said she <br /> had no idea this was going on. She didn't understand why the road now has to be <br /> plowed. She had pictures of the damaged vegetation and shared thein with the <br /> coinmissioners. Donald McCloud gave the history of Gooseberry Island and the access <br /> of the road. He said the footprint of the road has been widened from 8 feet to 15 feet <br /> wide. An evergreen tree has been knocked down. Dr. McCloud said the town has been <br /> plowing the road up to the abutters driveways and didn't understand why Mr. Haney <br /> wanted it plowed to the end. There vas much discussion between the McClouds and Mr. <br /> Haney. <br /> Mr. McManus noted some shaved off roots along the expanded footprint and scouring <br /> damage towards the end and felt it should be mitigated for. <br /> Mr: Haney explained the road is slanted and they had to grade it. He would be happy to <br /> do mitigation. Some of those trees are on private property and that homeowner is not <br /> present at the meeting . Mr. Haney would need permission from the homeowner to do <br /> mitigation. <br /> Mr. McManus felt it would,be prudent to bring the other homeowner in and <br /> get their opinion ofwhit they would like to be clone. The damaged vegetation is not on <br /> conservation land, it is on private property. Following a discussion, Mr. McManus <br /> suggested continuina this until the other homeowner can provide some input into what he <br /> feels needs to be clone. Mr. Haney should have come forward to the commission for the <br /> road work,, but it is a civil natter. Mr. Haney said he would be happy to replace the cedar <br /> tree. <br /> Ir. Haney gave the history of Gooseberry Island. <br /> He said the road predates all of the houses in the neighborhood. The road was actually <br /> dividing line. In the early Bos they paved tho road. The trust has the right to maintain the <br /> road because it is the access road to the island. <br /> Agent McManus stated his original reconu endati n was to issue a negative <br /> determination with the hopes the property owners can work it out. If the property owners <br /> feel there needs to be mitigation they can approach the department. He explained that the <br /> work conducted.-did not violate the performance standards of the flood zone and <br /> recommended a negative determination under the wetlands protection act. This is a civil <br /> matter not to be brought before this board, only the environmental impacts of what took <br /> place, which is what the commission are charged to protect. <br /> 4 <br /> No f irther comments from the public. <br /> Motion: Mr. Sweet moved a negative determination, seconded by Mr. Anderson. vote <br /> -o. <br />
