CHAPTER 172 SPECIAL CONDITIONS FOR: 43-2692 (Richard Cook) <br /> 1. .A. The work shall be limited to: . <br /> Establishment and operation of a 1;99,acre shellfish aquacultui a site in <br /> Popponesset Bay <br /> Any activities, alterations and/or work which are discovered during the course of any inspection by the <br /> Coma lssion and/or its Agent, and which are not included above; shall be du cause for the issuance of <br /> administrative notice, violation notice, enforcement order, fines, revocation o this permit and/or for the <br /> denialiof a Certificate of Compliance. <br /> B. This drder of Conditions authorizes the Conservation Agent and/or any des! nated member(s)of the <br /> Conservation Commission to enter onto the'.prop as necessary, to monit r compliance with this <br /> Order.of Conditions. This authorization for access, as described herein shal continue until such time <br /> as a Certificate of Compliance is issued by the Mashpee Conservation Comr iission and/or the Mass. <br /> Department of Environmental Profection, as applicable. <br /> With respect to all conditions, the Conservation Commission designates the Donservation Agent or <br /> other designated representative of the Commission, as its agent with full po ers to act on its behalf in <br /> administering and enforcing this Order. <br /> C. This Order of Conditions is subject to amendment, revocation'or a new appli ation should the <br /> Commission deem that: <br /> Incomplete work is causing damage to the interests of M,G.L. Chapter 131, <br /> section 40 and/or the wetland values of Chapter 172 of the Mashpee C de, <br /> and/or... <br /> new information, not available at the'time the Order of Conditions was ssued, has <br /> become available and indicates that the Order is not adequate to prote t the <br /> interests of M•G.L. Chapter 131, section 40 and/or the wetland values f Chapter <br /> 172 of the Mashpee Code. Said new information may include, but is not limited to, <br /> errors or omissions related to plans;narratives and/or other information supplied <br /> with the Notice of Intent upon which the Order of Conditions was Issued. <br /> Should the Commission choose to amend or revoke this Order of Condition , the ap,Iicanlpermit <br /> holder will be notified by certified mail and shall be allowed to respond and p esent evidence at a public <br /> hearing. Notice of said hearing shall be published in the local newspaper an J the hearing shall be <br /> conducted in accordance with the Open Meeting Law, M.G.L. Chapter 39, sE ction 23B.After the <br /> applicant/permit holder has had an opportunity to present his/her case, the Commission shall vote on <br /> amending or revoking the Order of Conditions. <br /> D. Notwithstanding any contents of the Notice of Intent for this permit and/or ar y provisions of this Order <br /> of Conditions, all work/aIterations on this site subject to this permit shall me the following <br /> performance standards for 310 CMR 10.00, and the regulations for Chapter 72 of the Mashpee Code. <br /> Failure to comply with the performance standards for the following resource reas: <br /> 310 CMR 10.02(1)(d)—Land subject to Coastal Storm Flowage <br /> �10 CMR 10.25—Land Under the Ocean <br /> 310 CMR 10.27—Coastal Beaches <br /> 310 CMR 10.29— Barrier Beaches <br /> A <br />
