BRUCE M HENRY (excused) <br /> II Mr . Kirsner introduced new member, Carey Murphy to committee <br /> members . <br /> III - DISCUSSION of TEN ACRE SITE ; <br /> Chin. Kirsner explained that the committee had made efforts to <br /> obtain legislation relative to transfer of title to th6 Ten <br /> Acre Site to the Town of Mashpee. So far, they have been un- <br /> successful . <br /> ul . <br /> Mr . Rirsn'er wanted to ca1:1 to the attention of the members and <br /> pubii'c present , from his point of view which hie has expres.sed <br /> to DEM in writing , ther'e 'is ah unconditional obligation on the <br /> part of the Department of Environmental. Management to convey <br /> the 10 A. Site to the "Town of Mashpee. That is clearly stated' <br /> in Paragraph 17 of the 1981 greeme t . Apparently DEM recognized <br /> their re.s-ponsibiiity , since short. before Rep . Tori Oahir ' <br /> retirement , Mr. Kirsner met with Tom Cahir and several- represen- <br /> tatives of DENS, and it was agreed that legislation would be filed ,, <br /> an-d it would be. prepared . When the prepared legislation was pre- <br /> sented 'to Mr. Kirsner and the committee, it was totally incon- <br /> sistent with what the Agreement called for . <br /> Mr . Kirsner explained that he had participated on behalf of the <br /> Town of Mashpee, in the original. drafting of this 1981 Agreement . <br /> It was very clearly expressed what the intention of the parties <br /> was , and than the ten acre site was to be a transfer without any <br /> monetary consideration given up by the Town. The Town had fur- <br /> n_i hed good and valuable consideration . <br />
