Town <br /> i Mashpee <br /> f <br /> i— V n .2649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2018-47 <br /> Laura Kanter Bk#: 08952 <br /> 9 Kanter Lane Page#: 0207 <br /> (Map 119 Parcel 1-D) <br /> Mashpee,MA 02649 <br /> A Petition was filed on September 18, 2018 by Owner, Laura Kanter requesting a <br /> Special Permit under§174-33 to allow for construction of a coastal bank walkover structure <br /> with a 4' x 4' landing at the top of the 4' wide stairway, which will descend a stone <br /> embankment on property located at 9 Kanter Lane, in an R-3 Zoning District, Map 119 <br /> Parcel 1-D, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on October 5, 2018 and October 12, 2018 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 24, 2018 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Board Member, Scott Goldstein, and <br /> Associate Members, Brad Pittsley and Sharon Sangeleer, Also present was Building <br /> Commissioner, Michael Mendoza. <br /> Mr.Kieran Healy,with BSC Group represented the homeowner,Laura Kanter. The <br /> plot plan he provided depicted a 4 x 4 landing highlighted in green, with a walk-over <br /> stairway to get to the beach. He also pointed out a similar designed structure at the adjacent <br /> property. There is no work being done to the house; it's just a simple walk-over structure <br /> to the beach. The structure is made of wood. The project was approved by the Conservation <br /> Commission. <br /> Mr. Pittsley read the Inspection Department comments into the record. Chairman <br /> Furbush read the Conservation Department comments into the record. <br /> Mr. Furbush told the applicant if any artifacts are found while digging,please refer <br /> to the bylaw regarding Archaeological Sensitive areas. <br /> There were no abutters present. There were no more comments from the Board. <br /> 1 <br />
